SHP Meeting Minutes of December 9, 2008- Tabled

 

Johnson Road

Susan Saunders delivered the letter concerning the SHP’s interest in the land to the BOS. There has been no response. Susan Saunders will call Ben Puritz to follow up.

 

SHP Annual Report

Alan Lury volunteered to write the 2008 report. Alan will send draft to members. Mary Tobin will send 2007 report to committee for reference.

 

Summary of Supreme Judicial Court-40B

Warren Kirshenbaum gave a brief overview of recent SJC decisions concerning 40B. Several cases were decided in the spring of 2008. Two concerned when a Town reaches its 10% affordable housing quota.  The SJC decided that if a developer submits an application prior to the Town’s achieving the 10% then the application is grandfathered and can go forward even when the10% is achieved in the interim.  Another case clarified where the burden of proof falls concerning when conditions imposed by a ZBA are considered to result in making a project “uneconomic”.  The burden of proof falls on the ZBA when a project is denied. However when a project is approved with conditions the burden falls on the developer to prove the conditions would result in making the project uneconomic. The DHCD also changed its 40B regulations to reflect SJC rulings.

 

Glenview Road

The Town decided to hold off on eviction proceedings due to the holidays. Eviction is going forward at the end of January. Jane Desberg and Town Housing Inspector were able to inspect the property. Some repairs are needed.  Apparently no rent has been paid since September 2007 (17 mo x  $1700 = ~30K). Susan Saunders will contact Ben Puritz to inquire whether insurance has been paid. She will also suggest that the Town needs to provide for repairs before the home can be put up for the lottery.

 

Wilber School

It was noted that the fence is now in place.

 

Other Parcels

Lou Modestino indicated that he is still in the process of looking into records concerning  235R Wolomolopoag and a lot on Old Post Road noted by Eli Hauser as potentially buildable.

 

New Business

Economic Development Committee Meeting

There will be a meeting at the Community Center on January 28 concerning the Post Office Square consultant reports- including the septic system. Alan Lury will send information to the group.

 

CPA Funding

Susan Saunders reported that there is presently no money to access in the CPA account. It would be best to wait until next year to apply for funds.
